1. AGREEMENT OVERVIEW

By purchasing, ordering, or accepting delivery from HVN Nightclub, the customer agrees to all terms outlined in this Master Legal Agreement, including Shipping, Delivery, Pickup, Returns, and Legal Policies.

Customers acknowledge that once a purchase is made, they fully understand, accept, and agree to all stated terms and conditions, including but not limited to our No Return Policy, delivery terms, and fees.


2. NO RETURN / EXCHANGE POLICY

  • All delivered merchandise is final sale
  • We do not accept returns under any circumstances
  • We do not honor buyer’s remorse or change of mind

Limited Exchanges Only

Exchanges may be approved only if:

  • Item is unopened
  • Item is unused
  • Item is in original packaging

All approved exchanges are subject to a restocking fee (up to 20%)


3. SHIPPING, DELIVERY & PICKUP

Customer Contact Requirements

Customers must provide:

  • Two valid phone numbers (primary required, secondary recommended)
  • Email address
  • Full delivery address

Delivery Notifications

Customers will receive:

  • Night before delivery confirmation
  • Morning of delivery update
  • 30-minute arrival notice


Shipping

  • Standard shipping fee: $25
  • Subject to carrier availability and product type


Local Delivery (White Glove Service)

  • Delivery fee: $10 minimum
  • Minimum order: $500
  • Service area: within 30 miles of Hamden, CT
  • Includes scheduled delivery and placement (service level may vary by product)


Pickup Policy

  • Free pickup: available after 3 days, by appointment only
  • Same-day pickup: $50 fee, appointment required
  • All pickups must be scheduled in advance


Missed Deliveries

Failed delivery due to incorrect information or customer unavailability may result in:

  • Additional delivery fees
  • Rescheduling delays
  • Storage or handling fees


4. INSPECTION POLICY

  • Customers must inspect all items upon delivery or pickup
  • Damage claims must be reported within 48 hours
  • Late claims may not be honored


5. PAYMENT TERMS

  • Full payment required unless otherwise agreed in writing
  • Chargebacks without prior contact may result in account suspension and collections action
  • We reserve the right to refuse any order


6. LIABILITY DISCLAIMER

USA Wholesalers Direct is not responsible for:

  • Carrier delays or third-party logistics issues
  • Improper use, installation, or handling of products
  • Indirect or consequential damages


7. PRICING & INVENTORY

  • Prices may change without notice
  • Inventory is not guaranteed until confirmed
  • We may cancel orders due to pricing or stock errors


8. LEGAL RIGHTS & ENFORCEMENT

We reserve the right to:

  • Refuse service to any customer
  • Cancel or modify orders
  • Enforce policies at our discretion
  • Protect against fraud, abuse, or chargeback activity


9. INTELLECTUAL PROPERTY

All branding, business name, materials, and content are the property of USA Wholesalers Direct and may not be copied or used without written permission.


10. POLICY UPDATES

This agreement may be updated at any time. Continued use of services constitutes acceptance of updated terms.
